The strongest worker protection in the country.

New York is the only state that imposes absolute liability on owners and general contractors for certain construction injuries. That framework — §240, §241(6), and §200 — is the spine of every serious construction case.

§240 — The Scaffold Law

Absolute liability for owners and GCs when a worker is injured by an elevation-related hazard — fall from height, falling object, scaffold collapse, ladder fall. Worker comparative fault is no defense.

§241(6) — Industrial Code Violations

Liability when a worker is injured because a specific provision of New York’s Industrial Code was violated. Defective equipment, unsafe walking surfaces, inadequate guarding, electrical hazards.

§200 — Common-Law Duty Codified
